I paid a 1 lakh rupee advance for a group house costing 15 lakhs. However, the builder isn’t following the agreed plan, the design has issues (like sewage pipes in the kitchen), and he’s asking for extra money for basic features. We’ve decided not to proceed because of these problems. Furthermore, we discovered the house is mortgaged, something the builder concealed while securing a housing loan for us. After learning this, I requested my advance back but the builder says he’ll only refund it when someone else buys the property. What can I do to get my money back?

You have grounds to demand a refund based on the builder’s breach of contract and misrepresentation. The builder’s refusal to refund despite the issues and concealment of the mortgage is unfair. You should issue a legal notice demanding the refund, and if unsuccessful, file a consumer complaint with the Consumer Forum and/or a civil suit for recovery.
