My family moved into our new flat in Bangalore in July 2014. There are 15 other flats in the building. The builder promised to handle maintenance until December 2014, after which an Owners’ Association would take over. However, the builder never introduced us to other residents and hasn’t taken any steps to form the association. When I asked him to organize a meeting, he said it’s not his responsibility. In January 2015, a resident close to the builder took over maintenance and decided on monthly charges without any discussion. What can we do to form an association and have a say in managing our building?

Under Indian law, apartment owners have the right to form an association to manage their building. You can contact the Registrar of Societies in Karnataka to register the association. You can also approach the Karnataka Real Estate Regulatory Authority (K-RERA) to file a complaint against the builder for failing to facilitate the formation of the association, as per the Apartment Ownership Act, 1972.
