My family is Hindu, and my father inherited 9 acres of agricultural land from our grandfather’s estate in 2001. He has now gifted the entire property to my 45-year-old married sister. While the land was originally documented under our grandfather’s name, there are no parent documents for 3.5 acres. However, this portion was resurveyed under my father’s name, and I have a patta and “A” register extract in his name. My father is still alive and in possession of the land. Can I legally challenge this transfer and claim a share of the property? What are my options?

As your father is alive, you can challenge the gift of the entire 9 acres to your sister. You can file a suit for partition claiming your share of the inherited property based on your father’s possession and the “A” register extract. Additionally, you can seek a declaration that the transfer was invalid as it did not involve all legal heirs, including you.
