My friend, someone gave us a post-dated cheque as a guarantee. Now we need the money back, but they’re refusing to return it. What should we do?

If the cheque is post-dated and the due date has passed, you can present it for payment. If the cheque is dishonored, you can file a criminal complaint under Section 138 of the Negotiable Instruments Act, 1881. Alternatively, you can file a civil suit for recovery of the amount due.
