I supplied materials to a customer based on a Memorandum of Understanding (MOU) and received cheques as payment. The customer delayed payment and, during a court hearing, verbally agreed to pay ₹25,000 per month. I filed a case under Section 138 in the JMFC court. However, the customer has stopped making payments since March 16th. Can I file a police complaint under Section 420 for the dishonored cheques? This is not a breach of contract case, I want to file for cheating. Please advise urgently. Thanks.
