How Do You Obtain A Lease Agreement?

Specify essential details, including rent amount, security deposit, lease duration, obligations of both parties, and termination terms.
The agreement must be printed on stamp paper of the appropriate value as per local laws, which can vary based on the state and the length of the lease.
Both the landlord and tenant must sign the agreement. Additionally, two unrelated witnesses should sign to validate the agreement.
Registration is required for leases longer than one year. For shorter leases, notarisation may suffice, but registration is recommended for full legal protection.
Both the landlord and tenant must appear at the local Sub-Registrar’s office with the signed agreement and necessary documents.
Present all required documents at the Sub-Registrar’s office.
The registrar will verify the agreement and supporting documents.
Pay the registration fee (typically around Rs 1100 in India) and the applicable stamp duty based on the property’s value or rent amount.
After successful registration, you will receive a unique registration number.
Once the process is complete, collect your registered lease agreement from the Sub-Registrar’s office.

What Are The Required Documents For Registration?

Provide the original title deed or other proof of ownership.
Documents like Index II or tax receipts.
Valid ID (e.g., Aadhaar card, passport, voter ID) for both parties and the witnesses.
Two passport-sized photos of each party and one for each witness.

How To Obtain A Copy Of Your Lease Agreement?

To get an official copy of the registered lease agreement:

Sub-registrar’s office or other authorities: You may seek the copy of your lease agreement from the office where the lease was registered.
Your landlord: The property manager should have a copy of your lease. Many states require them to provide it to you, so it’s a good idea to ask in writing to have proof.
Check with Local Housing Authorities: If your home is rent-controlled or rent-stabilised, your landlord has to file basic lease terms with the local housing authority every year. You can contact your local or state housing department to see if they have a copy.
Consult Court Records: If there was ever a court case about your lease, there might be a copy of it in the court’s records. You can ask the court clerk for a copy.
Recreate the Lease: If none of these options work, you can work with your landlord to write down the key terms of your lease, like the rent, lease term, and renewal date. This will help if there are any future disagreements.
Contact your mortgage provider: They may have a copy and can send it to you for a fee.
Check with your solicitor: If you used a solicitor when buying the property, they should have given you a copy.
Access your state’s online registration portal (e.g., Maharashtra’s portal).
Enter relevant details like the district, year of registration, and document type to locate the agreement.
You may need to verify your request using an OTP or other methods
Once located, you can download or print the registered lease agreement.

In conclusion, getting a copy of your lease should be simple whether you access it online or request it from your landlord or local authorities. Just follow these steps, and you’ll have your lease in no time.
