How To File A Case Under The Land Acquisition Act

Here are the steps to file a case under the Land Acquisition Act:

  1. Submit a Written Application to the Collector: Any person interested in the land who has not accepted the compensation award.
  2. Participate actively in the compensation determination process.
  3. Provide Reasons for Referring the Matter: In your application, clearly explain why you believe the matter needs referral for compensation determination.
  4. This could include: Disagreement with the compensation amount, Belief that the land has been undervalued and desire to claim additional compensation for damages or losses
  5. Await the Collector’s Decision: After receiving your application, the Collector will review the case. They will decide whether to refer the matter for determination of compensation. If the Collector approves the referral, they will submit the case to the court or authority specified in the Act for a final decision on the compensation amount.
  6. Participate in the Compensation Determination Process.
  7.  This may involve submitting additional evidence, attending hearings, and making arguments to support your claim for higher compensation.
  8. Accept the Final Compensation Award: The court or authority may determine the final compensation amount. Then, you will need to accept the award. If you are still unsatisfied with the compensation, you may have limited options to further appeal the decision.

Note:

It’s important to note that the Land Acquisition Act has been replaced by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 in most states. The process for filing a case may vary slightly under the new Act. The general principles remain the same.

You can file a case under the Land Acquisition Act if:

  1. You are an interested person whose land has been notified for acquisition under Section 4. You want to object to the acquisition.
  2. The government wants to withdraw from acquiring your land after issuing the notification but before taking possession.
