Explanation of Section 1 – Short Title and Extent

Section 1 of the Hindu Adoptions and Maintenance Act, 1956, introduces the Act formally. It performs two essential functions:

  • States the official name of the legislation: “The Hindu Adoptions and Maintenance Act, 1956”.
  • Clarifies the geographical extent of its applicability: it applies to the entire territory of India.

Key Points:

  • The Act is a personal law specifically for Hindus and deals with adoption and maintenance within the Hindu legal framework.
  • It originally did not apply to the State of Jammu and Kashmir due to Article 370. However, after the abrogation of Article 370 in 2019, it now applies uniformly across all of India.
  • This section is essential for legal practitioners as it determines the reach and jurisdiction of the law.
