IPC Section 132: Abetment of Mutiny

Section 132 of the Indian Penal Code (IPC) deals with the offense of abetment of mutiny.

This section defines abetment of mutiny as intentionally aiding, advising, or encouraging a person to commit mutiny. Mutiny, in this context, refers to an unlawful and concerted rebellion against lawful authority, particularly within a military or naval force.

3. Illustration:

Consider a scenario where a soldier is dissatisfied with his commanding officer’s leadership. He begins spreading rumors among his fellow soldiers, inciting discontent and urging them to rebel against their superior. This act of spreading dissent and encouraging rebellion constitutes abetment of mutiny under Section 132.

What constitutes aiding, advising, or encouraging mutiny?

This can include acts like providing information that facilitates mutiny, spreading propaganda, or making inflammatory speeches that encourage rebellion.

Is it necessary for the mutiny to actually occur for a person to be charged under this section?

No, it is not. The act of abetting itself is punishable even if the mutiny doesn’t materialize.

What are the penalties for abetment of mutiny?

The punishment for abetment of mutiny is imprisonment for life, or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
