Code – Section 88 BNS

Whoever voluntarily causes a woman with child to miscarry, shall, if such miscarriage
be not caused in good faith for the purpose of saving the life of the woman, be punished with
imprisonment of either description for a term which may extend to three years, or with fine, or
with both; and, if the woman be quick with child, shall be punished with imprisonment of
either description for a term which may extend to seven years, and shall also be liable to fine.
Explanation.—A woman who causes herself to miscarry, is within the meaning of this
section.

What Does This Section Cover?

  • Miscarriage caused without the woman’s consent is a serious offense punishable by up to 10 years imprisonment + fine.
  • Miscarriage with the woman’s consent is also punishable if it is not done in good faith to save her life.
  • Medical procedures done in good faith to protect the mother’s life are not punishable.

A doctor performs a medically necessary abortion to save a woman’s life. This is not an offense under Section 88 BNS.
