My mother rented out her commercial property about 10-12 years ago. Now, the tenant is refusing to leave. We had an 11-month lease agreement that wasn’t renewed. How can we legally reclaim our property?

Since the lease agreement expired and was not renewed, it is considered a month-to-month tenancy under Indian law. You can legally reclaim your property by serving a proper notice of termination, ideally at least 30 days prior to the desired vacating date. Consult a lawyer to ensure the notice is legally sound and can be used to initiate eviction proceedings if required.
