Under Muslim Personal Law (Shariat) Application Act, 1937, divorce can be initiated by either the husband or wife. The husband can pronounce ‘Talaq’ (irrevocable divorce), while the wife can seek a ‘Khula’ (divorce by mutual consent) or a ‘Talaq-e-Tafweez’ (divorce delegated by the husband). The wife can also approach a Muslim court for divorce on grounds of cruelty, desertion, or non-maintenance.
