Namaste. My sister got married eight months ago. Her husband went to Saudi Arabia for work and has been living there since. For the past six months, she has been requesting a khula (divorce) as she doesn’t want to stay with him. However, he keeps delaying the process, saying he’ll come back in December, but he hasn’t. He then promised to handle the khula procedures from Saudi Arabia, but for the past three months, she hasn’t been able to get in touch with him. What should she do in this situation?

Your sister can file a petition for divorce under Section 13 of the Hindu Marriage Act, citing her husband’s desertion and refusal to cooperate in the khula process. She can also approach the court to issue a notice to her husband in Saudi Arabia through diplomatic channels, compelling him to respond.
