You should not settle for a small amount. While Section 337 IPC might carry a small fine, you are entitled to compensation for your wife’s injuries and treatment costs. Consult a lawyer to pursue a claim for damages and medical expenses from the driver and insurance company, as the police’s advice is not legally sound.
