My tenant signed an 11-month lease agreement four years ago. The agreement has now expired, and he has vacated three out of the four rooms. He’s still occupying one room without a new agreement and has sublet it to someone else. He hasn’t paid rent for this room for the past five months. If I allow him to stay for another six months, can I file a case against him after that? I want to give him six more months because he requested it.
Yes, you can file a case against your tenant after the six-month period. Even though you’re allowing him to stay, his continued occupancy without a new lease agreement and non-payment of rent make him a tenant at sufferance. This allows you to file a case for eviction and recover unpaid rent.
