You can legally evict the tenant through a legal process. You need to issue a notice to vacate under Section 106 of the Transfer of Property Act, 1882. If he fails to comply, you can file an eviction suit in the court. The court will issue an order for his eviction if it is satisfied that the tenant’s stay is illegal.
