I work at a nationalized bank in India and they offer housing assistance. My family and I liked a flat in Gurgaon, but the landlord lives in Mumbai. A broker recommended we talk to the landlord directly, and he agreed to lease us the apartment over the phone. He requested an advance of ₹12,000 for painting the flat, which we transferred to his account. Now, there are some problems with the lease agreement, and we want to find a different apartment. We’ve asked the landlord to return the ₹12,000, but he’s refusing. What can I do to get my money back?

Under Indian law, an agreement made over the phone is legally binding, but you can argue that the advance payment for painting was a conditional payment, contingent on the lease agreement being finalized. You can initiate legal action against the landlord to recover the ₹12,000 by sending a legal notice demanding repayment and, if necessary, filing a suit in a consumer forum or civil court.
