A businessman, 30 years ago, obtained a loan from a bank using a partnership deed that mentioned his business location as a property owned by someone else. This person, who only entrusted the property to the businessman, did not officially rent it out. Now, the businessman claims tenancy based on this deed, despite never paying rent or having any rent receipts. Can this old deed be used against the property owner?

No, the old deed cannot be used to establish tenancy. Under Indian law, tenancy requires a valid rent agreement and payment of rent. The deed merely mentions the location and does not constitute a tenancy agreement, especially without rent payments or receipts.
