Respected Sir,
I’m a doctor pursuing MD at a government medical college in India. I’m on an in-service postgraduate program, meaning I’m a medical officer deputed by the Public Health Department for my MD. I recently received an appointment letter for a Central Government medical officer post and want to leave my MD seat. My deputation order states that leaving the PG seat would require me to reimburse the salary for the time I’ve worked. However, the medical college is demanding 16 lakhs, citing the lapse in their PG seat. Could you advise on the legal aspects of this situation? I can manage to pay 8 lakhs now. Is it possible to pay the remaining 8 lakhs later?

The medical college’s demand for 16 lakhs appears excessive. While you may be obligated to reimburse the salary received during your deputation, the college cannot demand payment for the lapse in their PG seat. You can negotiate with the college to pay the remaining 8 lakhs later, but this would depend on their agreement. Consulting a legal expert is recommended to ensure your rights are protected.
