Respected Sir,
I understand that government employees can be suspended if they remain in custody for over 48 hours. I was previously suspended for this reason but the suspension was lifted within a month, even though the criminal case was ongoing. However, after 3.5 years, the authorities are proposing to set up an inquiry committee and possibly suspend me again. Could you please clarify the rules regarding this situation?

Under Indian law, a government employee can be suspended if they remain in police custody for more than 48 hours. While your suspension was lifted earlier, the authorities are not barred from initiating a fresh inquiry and considering suspension again, especially if the criminal case is still pending. The exact rules governing this process are governed by the relevant service rules of your department and the specific provisions of the Central Civil Services (Conduct) Rules, 1964.
