My July and August 2013 salary was held back after the managing director threatened me to resign via email, copying another director and his assistant. This came after I received a notice from the Municipal Corporation about their illegal advertisement hoardings. Two months later, I was told to leave the office premises immediately. Can I file a complaint with the Prevention of Human Rights Commission? The Legal Counsel recommended filing a claim with the Delhi Labour Court under the Delhi Shops and Commercial Establishments Act.

You can file a complaint with the National Human Rights Commission (NHRC) as the actions of the managing director, including salary withholding and forced resignation, may constitute a violation of your right to work and livelihood. However, as the Legal Counsel has advised, filing a claim with the Delhi Labour Court under the Delhi Shops and Commercial Establishments Act may be more effective in recovering your withheld salary and seeking compensation for unfair termination.
