You can file a complaint with the National Human Rights Commission (NHRC) as the actions of the managing director, including salary withholding and forced resignation, may constitute a violation of your right to work and livelihood. However, as the Legal Counsel has advised, filing a claim with the Delhi Labour Court under the Delhi Shops and Commercial Establishments Act may be more effective in recovering your withheld salary and seeking compensation for unfair termination.

However, there’s a newer version of the service rules published in 2014, which doesn’t mention this 3-month penalty. The HR department claims they forgot to update the document. Shouldn’t the latest version of the rules be considered valid in this situation?
