My husband worked as a security guard at a private company. He was suspended when some money went missing under his watch. Thankfully, the money was recovered and returned. However, he hasn’t been called back to work, and they haven’t paid him his dues. He wasn’t found guilty in the whole matter. Can he ask for his job back and his pending payments? What legal options does he have?
Best Answer
Your husband can seek reinstatement to his job and payment of his dues as his suspension was based on suspicion, not proven guilt. He can file a complaint with the Labour Commissioner and seek redress under the Industrial Disputes Act, 1947. He can also file a civil suit for wrongful termination and unpaid wages.
