My father works at Dr. APJ Abdul Kalam University in Lucknow. He received a transfer order, which he challenged in the Lucknow High Court, claiming it was issued with malicious intent. The court accepted his plea. However, while the case was ongoing, the university suspended his service for the same reason – refusing the transfer order. Can the university take such action while the matter is in court? Is this legal?

Under Indian law, suspending an employee during a legal challenge to a transfer order is generally considered illegal unless there are exceptional circumstances justifying immediate action. The university’s action could be deemed as contempt of court, especially since the court had already accepted your father’s plea.
