My company, a public sector undertaking (PSU), isn’t recognizing our registered union for collective bargaining. We’re a group of unionized supervisors, officially acknowledged as such by the company in a letter to the Ministry. However, the company claims we’re part of management and not covered by the Industrial Disputes Act, thus denying our union collective bargaining rights. Given our official recognition as unionized supervisors, could our union still be eligible for collective bargaining? We urgently need the power to bargain for our rights.

Under Indian law, supervisors can be recognized as workers and enjoy the rights under the Industrial Disputes Act, including collective bargaining, if their primary function is supervisory and they do not exercise managerial powers. Given your official recognition as unionized supervisors, your union can argue for collective bargaining rights, especially if your duties primarily involve supervision rather than managerial decision-making.
