I’ve been working as a Senior Branch Manager at Bank of India since August 2012. Recently, in May 2016, the bank revised its promotion policy. Now, to be considered for promotion from Scale III to IV, we must have worked in rural or semi-urban branches. This requirement doesn’t apply to other promotions. Since we don’t get to choose our postings, the bank assigns us based on their needs. Can I legally challenge this policy as discriminatory?

You may be able to challenge the promotion policy as discriminatory under Indian law, arguing that it unfairly disadvantages employees who have not served in rural or semi-urban branches. The policy’s application to only one promotion level and its non-selection based posting criteria could be considered discriminatory. It’s recommended to consult with a lawyer specializing in employment law to assess the specific legal arguments and chances of success.
