I’m about to complete two months at my job, but I’ve decided to resign to pursue a course. My contract doesn’t mention a probation period, and it says I need to give three months’ notice or pay three months’ salary if I leave before that. My company wants me to work the full three months, or pay them back my salary for the missing time. It feels unfair to work for two months and still have to serve a three-month notice period. What are my options?

Indian law allows for a notice period as per the contract. However, the “pay in lieu of notice” clause is usually applicable only after completion of the probation period. Since your contract doesn’t mention a probation period, you can negotiate a shorter notice period with your employer or pay the salary for the remaining notice period.
