You can file a claim for your gratuity under the Payment of Gratuity Act, 1972 in a Labour Court in either Maharashtra or Uttar Pradesh. The court can order your former employer to pay the gratuity, along with interest and compensation. You should consult a lawyer to file the claim and understand the legal process.
