I work at a private bank in Manipur. We were regularized on February 1st, 2014, but haven’t been confirmed yet after a year. The bank created a seniority list based solely on the regularization order, disregarding individual merit. Can seniority be determined only from the order list without considering merit? The order doesn’t mention any tentative seniority, and the initial appointment order also didn’t include a merit list.

While regularization generally signifies the completion of probation, it doesn’t automatically determine seniority. Indian law doesn’t mandate seniority solely based on regularization order, especially if merit was not considered in the initial appointment or regularization order. Your bank’s seniority list should consider both regularization date and individual merit, as per the bank’s internal policies and applicable labor laws.
