I was selected for a job in 2005, but received my appointment letter only in 2014. The delay was unexplained, despite the vacancy advertisement specifically mentioning a special recruitment drive for backlog vacancies of Scheduled Tribes and Scheduled Castes in 2005. Another candidate joined the same service in 2006. Can I claim seniority from the year my selection process was completed (2005) considering these circumstances? I’d appreciate any guidance on this matter.

Under Indian law, seniority is usually determined by the date of joining the service. Your selection in 2005 does not guarantee seniority. However, the delay in issuing your appointment letter and the special recruitment drive for backlog vacancies might be relevant factors to consider for seeking redressal through legal means.
