I recently left my job at a leading Indian e-commerce company in May 2016. When I received my final settlement, I noticed that I wasn’t paid for all my accumulated leave. I had around 29 PL and 20 CL days, but I was only compensated for 7.5 days. My former employer claims this is according to their policy, but I believe it’s unfair. While limiting leave carryover during employment makes sense, I should be paid for all my unused leave upon resignation. What are my legal options?

Under Indian law, you are entitled to encash your accumulated leave upon resignation, even if your company policy limits carryover. The amount payable depends on your company’s policy and the applicable labor laws. You can seek redress through conciliation, mediation, or legal action, including filing a complaint with the labor commissioner.
