I quit my previous job without receiving my final settlement. They wouldn’t let me leave without serving the full notice period. My offer letter says I need to give three months’ notice to leave, and they can do the same. It also says they can terminate me by paying me three months’ salary in lieu of notice. However, it doesn’t say I have to pay them three months’ salary if I leave early. Now, they’re demanding three months’ salary and threatening legal action. They recently gave us an employee handbook mentioning the three-month salary clause, but I never signed it.

Your offer letter specifies a three-month notice period for both parties. While the company can terminate you by paying three months’ salary, there is no reciprocal clause stating you must pay them. The employee handbook, not signed by you, is unlikely to be legally binding. However, seeking legal advice is recommended to assess the specific situation and potential legal ramifications.
