I quit my job on February 28th, served two months’ notice, and am willing to forfeit a month’s salary for the remaining period. I’m set to join a new company on May 10th, but my current employer is refusing to release me, demanding I stay until May 25th to complete three months. I work on a client’s site. My HR department has threatened to mark me as absent if I stop going to the client’s office. Could they withhold my experience letter if I leave on May 6th?

In India, the law generally requires you to serve the full notice period as per your contract. While you can forfeit salary for a shorter period, your employer can legally withhold your experience letter until the end of your contractual notice period. However, seeking a compromise with your employer and HR might be beneficial to avoid any future complications.
