I lost my job at American Express India in June 2014. They fired me unfairly, and I filed a case with the Central Government Industrial Tribunal in Delhi. But American Express argued that since I worked in their travel division, the Central Tribunal doesn’t have authority, claiming they’re primarily a banking company. They want the case transferred to a state-level tribunal. What legal options do I have to fight this?

You can argue that American Express India’s travel division falls under the ambit of “industry” as defined by the Industrial Disputes Act, 1947, and therefore, the Central Government Industrial Tribunal in Delhi has jurisdiction. You can also challenge the transfer to a state-level tribunal by arguing that it would cause undue hardship and delay in resolving the matter.
