I left my previous company on April 15th, 2016, and have a written resignation letter as proof. My salary was stopped after I submitted my resignation in March 2016, as per company policy, with the promise of reimbursement in my full and final settlement. However, I haven’t received any written communication regarding this settlement. Whenever I call, the HR department says they are unavailable or not present. My full and final settlement should be around 1 lakh rupees, a significant amount. What legal options do I have to ensure I receive this payment?

You can issue a legal notice to your former employer demanding the full and final settlement. If they fail to respond within a reasonable timeframe, you can file a lawsuit in a labor court seeking recovery of the unpaid dues. Additionally, you can file a complaint with the Labor Commissioner’s office, who can investigate the matter and order your former employer to make the payment.
