I had an accident on June 16th, 2015, and recovered on August 31st, 2015. I lost two finger bones on my right index finger (B2 injury). My monthly salary was Rs. 40,000. The relevant factor for my injury is 205.95, leading to an 11% loss of earning capacity.
I have a few questions:
1. Will I be eligible for full salary during my injured period?
2. How much compensation should the company pay me? I calculated the compensation to be Rs. 1,75,000 (based on 8000 x 205.95 x 11%).
3. What is the total compensation amount including my salary?
Best Answer
Under Indian law, you are not entitled to full salary during your injured period. The compensation amount is calculated based on the loss of earning capacity, the relevant factor, and your monthly salary. Based on your details, the calculated compensation of Rs. 1,75,000 seems accurate. The total compensation would be Rs. 1,75,000 plus your salary for the period you were unable to work (July and August 2015).
