As a group of around 450 employees working in a railway PSU, we were hired through an all-India test and interview process. Our work is permanent in nature, but we’re employed on a contractual basis, with our contracts renewed annually. Some of us have been with the company for over 8 years. Is there a legal avenue, like approaching the court, to seek regularization of our service? Your advice on this matter would be greatly appreciated.

Yes, you have a strong legal ground to approach the court for regularization. The Supreme Court has ruled that if work is permanent in nature and employees are engaged for an extended period on contractual basis, it amounts to “sham contract” and they are entitled to regularization. You can file a writ petition in the High Court challenging the continued contractual employment and seeking regularization.
