My brother passed away last February. He had a personal accident insurance policy where I’m the nominee. His wife and child are also family, but the policy papers are with his sister-in-law, who’s refusing to return them. LIC agents say his wife has legal rights, but I’m the nominated beneficiary. Can she still claim the insurance?

Under Indian law, the nominee in a personal accident insurance policy is entitled to the claim. While your brother’s wife may have legal rights to his assets, the nominee is the primary beneficiary. Your sister-in-law’s refusal to return the policy papers may be addressed legally.
