My father had two children from his first marriage, which ended in divorce forty years ago. He then remarried and had three children, including me. My mother has acquired property over the past decade. Could the children from my father’s first marriage claim a share of this property in the future? My mother doesn’t want to give them anything and wishes to leave everything to us, her three children, through a will. Would this will be legally valid?

Under Indian law, the children from your father’s first marriage are not entitled to inherit any share of the property acquired by your mother during her marriage to your father. Your mother’s will leaving her property to you and your siblings would be legally valid and would override any claims from your father’s first wife’s children.
