My elderly mother, 67 years old, lives in her own flat. Her son, who has his own flat, stays with her. He receives no support with food, medicine, etc. His wife sometimes uses abusive language and even threatens violence. The son demands his share of the mother’s property or refuses to leave. We’re worried about her safety and want to help. Can we legally remove them from the house? We are a Muslim family, and any urgent advice would be greatly appreciated.

Indian law doesn’t permit forceful eviction of family members from a property unless a court order is obtained. You can seek legal recourse by filing a complaint of harassment and abuse against the son and his wife, seeking a restraining order and possibly a legal declaration on the ownership of the property. Consulting a lawyer is crucial to navigate the legal process and protect your mother’s safety and rights.
