My dad registered his property in my mom’s name. The deed states it will go to her son after her passing. Can my sisters claim a share of this property?
My father inherited a property from his family. His brother has given a no-objection certificate. After my dad, who can claim the property – mom, son, or daughters? How will it be divided? Can we prevent my sisters from claiming a portion of the property?
Best Answer
In the first scenario, your sisters may have a claim based on the Hindu Succession Act, which gives equal inheritance rights to sons and daughters. The deed’s statement about the son inheriting the property might not be legally binding.
In the second scenario, the property will be divided according to the Hindu Succession Act. Your mother will inherit the property as your father’s legal heir. After her passing, you and your sisters will inherit the property equally. It’s unlikely you can prevent your sisters from claiming their share.
