I’m going through a divorce case in Chandauli Family Court (U.P.) under Section 13B. As per the court’s order, I’ve already settled everything with my wife, including the agreed amount and her requests, and the court has noted this in its order. The court has mentioned that both of us want the divorce and the settlement is final. However, my wife is now refusing to appear in court. The 18-month period for Mutual Consent Divorce (MCD) will be complete in April. The judge says that since it’s an MCD case, I need to convince her to come to court for the next hearing. Can you please advise on how to proceed?

Since the settlement is finalized and both parties consented to the divorce, the court’s order should be sufficient for the decree. Your wife’s refusal to appear may delay the process, but it shouldn’t prevent the divorce. Consult a lawyer to explore options for moving forward with the decree based on the court’s order and the finalized settlement.
