A husband and wife, both government employees, are getting a divorce. The husband agreed to transfer a house worth roughly 70 lakhs to his wife. The agreement was that she would sign the divorce papers in court and pay him 30 lakhs in two installments. She paid the first 15 lakhs and signed the papers. Now, she’s refusing to pay the remaining 15 lakhs. Can the husband legally stop the transfer of the house?

Under Indian law, a signed divorce agreement is legally binding. Since the wife already signed the agreement and received the house, her refusal to pay the remaining 15 lakhs could be considered a breach of contract. The husband may have grounds to seek legal recourse to enforce the agreement and prevent the transfer of the house until the remaining payment is received.
