We’re a group of 32 flat owners in a BBMP area, including 6 flats owned by the builder who lives here. We’re eager to form a society for our building. Can you guide us on the registration process? Should we hire a lawyer or can we handle it ourselves? The builder says he’ll only hand over the flats once the society is formed. Any advice is appreciated.

In India, forming a society requires registration under the Societies Registration Act, 1860. While you can handle the process yourself using the prescribed forms, it’s advisable to consult a lawyer to ensure compliance and avoid complications, especially given the builder’s involvement. Regarding the builder’s request, his refusal to hand over flats prior to society formation is unacceptable and may be legally challenged.
