A family member received a certificate from the Tahsildar after everyone in the family agreed. Later, this same person went to another Tahsildar, but included different people in their family certificate. Because the first certificate already existed, the second Tahsildar refused to issue a new one. This person then went to the High Court to fight this refusal. Meanwhile, they also asked the first Tahsildar to cancel their old certificate. The first Tahsildar said this was wrong, but agreed to cancel the certificate and told everyone to go to the regular court for this kind of issue.
Best Answer
The High Court would likely uphold the second Tahsildar’s refusal as the first certificate already exists, creating a conflict. The High Court may also advise the individual to seek redress through regular civil courts as the Tahsildar’s role is administrative, not judicial.
