We were married in 2007 and enjoyed a happy life for 5 years, but sadly couldn’t have a child. My husband’s family blamed me, even though medical tests showed he was the one struggling. They pressured me to allow a second marriage, but I refused. They then sent me back to my parents’ home and in 2012, filed a case to nullify our marriage, which is still ongoing. Unbeknownst to me, he married again in February 2015. After discovering this, I filed a bigamy case against him, but due to a judge shortage, it’s still pending.

Under Indian law, your husband’s second marriage is illegal as it constitutes bigamy. You are justified in filing a bigamy case against him, and the ongoing nullification case may not affect the validity of your marriage for the purpose of bigamy.
