We got married a year ago in a simple ceremony. We only spent one night together since then and haven’t lived as husband and wife. Can I get our marriage annulled because we haven’t lived together for a year? Do both of us need to agree to the annulment? Can I file for this alone?

Under Indian law, a marriage can be annulled based on non-consummation, but only if it’s proven to be due to a physical or mental incapacity. A mere lack of cohabitation for a year isn’t sufficient grounds. Both parties need to agree to the annulment, and filing it alone is possible but requires strong legal justification.
