My wife is from Karnataka and I’m from Hyderabad, Telangana. We got married in Hyderabad, but she’s currently living with her family in Bangalore. If I file for divorce in Hyderabad, how can I prevent the case from being transferred to Karnataka? I’m concerned because the records and evidence are in my local language, which could be a challenge in Karnataka.

Under the Indian Divorce Act, a divorce petition can be filed in the court where either party resides or where the marriage was solemnized. As your marriage took place in Hyderabad, you can file for divorce there. However, your wife can apply for transfer of the case to Bangalore if she can prove that it is more convenient for her. You can argue against the transfer by presenting evidence that the case can be fairly and efficiently adjudicated in Hyderabad.
