My wife and I are going through a tough time. After I got married, I had some unavoidable conversations with my ex-girlfriend for about a week. These chats were inappropriate and I deeply regret them. I’ve made a strong decision to never cheat on my wife again, but it’s too late – she’s very upset. I’ve heard conflicting advice from different lawyers about whether these chats, which contain vulgar language, could lead to a divorce. I want to know, if my wife has proof of these messages, will it be enough for her to get a divorce?
Under Indian law, adultery is no longer a ground for divorce. However, your wife can seek divorce on grounds of cruelty, which can be established based on the nature and content of your messages. If the messages are demonstrably vulgar and show emotional distress caused to your wife, it could strengthen her case for divorce.
