My wife and I agreed on a divorce and signed a legal document on a ₹100 stamp paper. We have the same lawyer. Our first court hearing was a holiday, and my wife didn’t show up on the next date, nor is she answering calls. My lawyer says we need both our parents in court. My wife’s parents are pressuring her not to go to court and aren’t willing to come. We initially requested custody of our 8-year-old child, but the court granted custody to my wife after 3 months. How can I finalize the divorce, and what can I do about the custody situation? The divorce petition was filed in March 2016.

You can file an application for divorce on the grounds of your wife’s desertion. Your wife’s parents cannot legally force her to stay in the marriage, and their pressure is not a valid legal reason for delaying the divorce. As for custody, you can file an application to revisit the custody order, presenting evidence of your wife’s lack of engagement and your ability to provide a suitable environment for your child.
