My sister was forced into a divorce by her husband, who pressured her into it without informing us. They’ve been married for two years and have a one-year-old daughter. Now, her husband and his family are refusing to let her take their child, and they’re preventing her from leaving their home. We were unaware of the situation until recently. When we tried to speak with her in-laws, they told us not to interfere. Can we get custody of the child and file for maintenance since the divorce has already been finalized? We’re worried for my sister and her daughter. What legal options are available to us?

You can file a custody petition on your sister’s behalf seeking custody of the child and maintenance for her. Since the divorce was finalized without her consent, it can be challenged on grounds of coercion and fraud. A court can grant custody based on the child’s welfare and can also order maintenance for your sister.
